El pasado lunes 30 de agosto el Día Internacional de los Desaparecidos fue ampliamente celebrado en todo el mundo.

Comunicaciones, comunicados de prensa, películas, eventos de la memoria, y otras acciones y actividades se realizaron en este día en conmemoración de aquellos que fueron y siguen siendo desaparecidos por sus gobiernos. Las familias y amigos de las víctimas, ahora los activistas para la defensa de los derechos humanos, se unió a todo el mundo para pedir a los Estados a que pongan fin de inmediato esta violación y proteger a sus ciudadanos. Linking Solidarity ha recogido información sobre estas actividades de diferentes partes del mundo, que vamos a poner a continuación.

A Joint statement on the International Day of the Disappeared

30 August 2010 - Today we honor all persons who have become victims of enforced disappearance all over the world. As we observe the International Day of the Disappeared, we revisit the chronicles of courage and self sacrifice of the desaparecidos which remind us that the commission of involuntary disappearance particularly against suspected enemies of the state persists with impunity.

The abominable global offense, a State-perpetrated violence, has spawned violations of practically all human rights. Precious lives are snuffed out, civil liberties curtailed, voices of protest and resistance muffled amidst a chilling culture of impunity.

Putting an end to enforced disappearance poses a great challenge to human rights advocates and defenders. Far greater is to successfully compel states to sign and ratify the International Convention for the Protection of All Persons from Enforced Disappearance and ensure that enforced disappearance constitutes a criminal offense in their statute books.

Learning from the Philippine experience, it is possible to enact special laws criminalizing human rights violations. In November last year the Philippines enacted Republic Act No. 9745 or the Anti-Torture Law. Lamentably, the proposed law defining and penalizing enforced or involuntary disappearance still awaits congressional imprimatur even as the Convention remains unsigned.

The Asian Federation Against Involuntary Disappearances (AFAD) and the Families of Victims of Involuntary Disappearance (FIND) strongly urge Philippine President Simeon Benigno Aquino III and the Chief Executives of Timor Leste, India, Indonesia, Pakistan, Thailand and Nepal to take the lead in effecting their respective states’ signing and/or ratification of the Convention. (India is a signatory but not yet a state party).

To date, the international instrument has 83 signatories and 19 state parties. The Netherlands is reported to have virtually reserved for the 20th slot that will mark the Convention’s entry into force. Shouldn’t AFAD’s member organizations’ respective states and other Asian states race to be the 20th state party and show to the world that they are sincere in upholding human dignity and human rights more particularly the right not to be disappeared?

This morning we launch “Unsilenced,” the AFAD video documentary on the disappearance of the six PICOP (paper factory) workers in Agusan del Sur in the Southern Philippines. The families of the six desaparecidos adamantly refuse to be silent and have remained courageous and steadfast in the quest for justice even as FIND has been unrelenting in giving assistance and support to the families and witnesses from Day One of the legal battle.

With growing support from the Philippine Alliance of Human Rights Advocates (PAHRA), AFAD and kindred groups, the families are more inspired to pursue the fight to its final resolution. Amidst daunting challenges, they stand resolute, brave and hopeful to duplicate in the multiple murder case which is now in the Office of the Provincial Prosecutors in Patin-ay, Prosperidad, Agusan del Sur their 2008 landmark victory in the kidnapping and serious illegal detention case in the Agusan del Sur Regional Trial Court.

As we pay tribute to the world’s desaparecidos, we also salute their families more particularly those who fought hard for the United Nations’ adoption of the Convention and work harder for its entry into force. We also take our hats off to those who tirelessly lobby governments to enact anti-enforced or involuntary disappearance domestic laws. These laws that seek to combat impunity serve as an enduring tribute to the desaparecidos.

Let there be no more PICOP 6 to search and grieve for. Let there be no more perpetrators of enforced disappearance in Asia and the whole world.

Statement by United Nations Working Group on enforced or involuntary disappearances

Geneva (30 August 2010) -- Today the United Nations Working Group on Enforced or Involuntary Disappearances commemorates the International Day of the Disappeared. All over the world, events have been organized by the families and associations of victims to remember those that have suffered the terrible fate of being disappeared. Yet, the Working Group believes that this day ought to be commemorated by all. It is gratified that the Human Rights Council has accepted the recommendation of the Working Group that 30 August be proclaimed the International Day of the Disappeared. The Working Group supports the call by the Human Rights Council for the United Nations General Assembly to recognize this day annually. This would put a further spotlight on these heinous acts.

Thirty years after the Working Group’s establishment, which will be commemorated at an event to take place in Geneva on 5 November this year, it condemns the fact that enforced disappearances continue to occur all over the world. The Working Group reiterates its solidarity with victims, their families and others who work on the issue. It pays tribute to the many relatives of victims, human rights defenders, non-governmental organizations, lawyers and other individuals and groups who work untiringly and often in difficult circumstances to denounce cases of enforced disappearance, discover the fate or whereabouts of the disappeared, and work to eradicate this terrible practice. It invites all Governments to support the efforts of those working on enforced disappearances and to take all available measures to protect them and others, including witnesses to these crimes.

To end the practice of enforced disappearances States should continue promoting and giving full effect to the Declaration on the Protection of All Persons from Enforced Disappearance. Defining enforced disappearance as a separate and autonomous criminal offence and bringing domestic legislation in conformity with the Declaration would significantly contribute to the prevention and eradication of this odious practice. The Working Group stands ready to assist states in their endeavors to give full effect to the Declaration.

The work of the Working Group is dependent on the cooperation of Governments. The role of states in investigating cases of enforced disappearances is essential to determining the fate or whereabouts of disappeared persons. The Working Group therefore calls upon Governments to fully cooperate with the Working Group and take all possible measures to address cases of enforced disappearances regardless of when the disappearance occurred, who the victims were or who the perpetrators are.

States should bring all those responsible for these crimes to justice; refrain from any act of intimidation or reprisals against those persons who contribute to the eradication of this crime; and fight impunity wherever it exists.

The Working Group is pleased to note that recently in a number of countries more has been done to investigate disappearances. It is also gratified that in various states there have been convictions for those who have perpetrated enforced disappearances and that in some cases reparations have been paid to victims or their families. More, however ought to be done to prosecute offenders, provide integral reparations to victims and family members, and to preserve memory.

The Working Group recalls that, as noted in its recently released General Comment on the Right to the Truth in Relation to Enforced Disappearances, the right to the truth entails the right to know about the progress and results of an investigation, the fate or whereabouts of the disappeared persons, the circumstances of the disappearance, and the identity of the perpetrator(s). The Working Group emphasizes that the right to the truth should be enjoyed by all the victims of enforced disappearances as well as others affected by enforced disappearances. Reconciliation between the State and victims of enforced disappearances and/or their families cannot happen without the clarification of each individual case.

The Working Group is gratified that, as of 30 August 2010, 83 States have signed and 19 States have ratified the International Convention for the Protection of all Persons from Enforced Disappearance. The ratification or accession of only one more State party is required before the Convention enters into force. The implementation of the Convention, and the coming into being of the Committee on Enforced Disappearance, will strengthen States’ capacities to reduce the number of disappearances and will help realize the demands of victims and their families for justice and truth. The Working Group urges States that have not yet signed and/or ratified the Convention to do so as soon as possible. It also calls upon States to accept the competence of the Committee on Enforced Disappearances to receive and consider communications from or on behalf of individuals under article 31 and the inter-State complaint mechanism under article 32 of the Convention.

The Working Group was established by the United Nations Commission on Human Rights in 1980 to assist families in determining the fate or whereabouts of disappeared relatives. The Working Group endeavours to establish a channel of communication between the families and the Governments concerned, to ensure that individual cases are investigated, with the objective of clarifying the whereabouts of persons who, having disappeared, are placed outside the protection of the law. In view of the Working Group's humanitarian mandate, clarification occurs when the fate or whereabouts of the disappeared person is clearly established. The Working Group continues to address cases of disappearances until they are resolved.

The Working Group on Enforced or Involuntary Disappearances is comprised of five independent experts from all regions of the world. The Chair-Rapporteur is Mr. Jeremy Sarkin (South Africa), and the other Expert-Members are Mr. Ariel Dulitzky (Argentina), Ms. Jasminka Dzumhur (Bosnia and Herzegovina), Mr. Olivier de Frouville (France) and Mr. Osman El-Hajjé (Lebanon).

une dizaine d’arrestations de familles de disparus à Alger

 

Ce 30 août 2010, à l’occasion de la journée internationale des disparus, les familles de disparus en Algérie, à l’image de celles de tous les continents, sont sorties dans la rue. La répression  vécue à Alger ces dernières semaines ne les a pas dissuadées d’organiser un rassemblement pour leurs disparus devant la Grande Poste en plein centre ville. Dans les autres villes du pays, à Oran et à Constantine, des rassemblements ont été organisés respectivement devant le tribunal et la wilaya. A Oran, les familles se sont immédiatement vues confisquer leur banderole et leurs panneaux où étaient revendiquées « Vérité et Justice ».

A Alger, une centaine de proches de disparus ont déroulé une longue banderole « 30 août : journée internationale des disparus », ont lâché des ballons au logo de l’association et brandi haut les photos des disparus. Les slogans ont commencé à s’élever et à attirer l’attention des passants. Plusieurs personnes intéressées ont pu, pour la première fois, s’approcher et poser des questions aux mères de disparus. Le rassemblement a ainsi battu son plein dans le calme, durant trois quart d’heure, profitant de l’absence des forces de l’ordre.

Cependant, ce moment de liberté ne s’est pas plus prolongé. Les policiers, alertés, sont arrivés en force et ont déployé une dizaine de véhicules de police autour de la place. Ils se sont rués sur les parents de disparus avant même de demander à la foule de se disperser. Un des représentants du syndicat SNPAPAP, venu soutenir les familles, a été le premier arrêté après avoir été roué de coups parce qu’il scandait les slogans avec force. En tout, neuf personnes ont été emmenées au commissariat de Cavaignac à Alger : deux pères de disparus, âgés de 80 ans, une mère de disparu âgée de 74 ans, deux jeunes sœurs de disparu, des frères et des fils de disparu. 

La journée internationale des disparus n’a, pour les autorités et les forces de l’ordre algériennes, aucune signification. Cette journée symbole dénombre en effet le plus grand nombre d’arrestations de proches de disparus depuis l’interdiction du rassemblement hebdomadaire début août. En Algérie et dans plusieurs pays du monde, des réactions de solidarité émergent et encouragent les familles de disparus à défendre leurs droits fondamentaux à la liberté d’expression et de manifestation pacifique. Elles ne se tairont pas et ne tournerons pas la page, pour la Vérité et la Justice en Algérie.

 

« Nous avons le droit de pleurer sans nous cacher. Parce qu’aujourd’hui, nous pleurons en nous cachant. Nous ne voulons pas nous cacher. Nous voulons que la face du monde nous voie. Nous sommes là, nous existons. Nous avons imposé notre existence. Et nous continuerons à l’imposer. Personne ne pourra nous faire taire. Personne ne nous effacera de la planète. Personne ne nous dictera notre conduite. Nous ne rentrerons pas chez nous tant que nous n’aurons pas fait la Vérité. Et tant qu’ils ne nous aurons pas rendu nos enfants ».
